What this is

#WithYouToo is Sexual Assault First Aid™: guidance for the first person someone tells, and for people taking care of themselves. It is made by 3Joannes, Inc. ("3Joannes", "we", "us") from 3Joannes' own material. These terms cover the app on iPhone and Android and the website at sexualassaultfirstaid.com. By using them you agree to these terms and to the privacy policy, which is part of them. If you do not agree, please do not use the app.

The guide in the app is an AI. It is not a person, not a counselor, and not a substitute for one. It can be wrong. It gives general information and support, not medical, legal or psychological advice, and a human advocate or counselor can do things it cannot.

Emergencies

If anyone is in danger right now, call 911. If someone may hurt themselves, call or text 988 (US) or find a free, confidential line at findahelpline.com. The app lists these under Resources, which is on every main screen. The app is not an emergency service and no one monitors conversations.

Who can use it

The app is written for adults supporting adults. You must be 18 or older to use the guide; the app asks you to confirm this before your first message. The app is not for children under 13.

You are responsible for how you use the app and for what you send to the guide. Please keep names and details out: the guide does not need them to help.

Your license to use the app

3Joannes gives you a limited, personal, non-transferable, revocable license to install and use the app on a device you own or control, for your own non-commercial use, under these terms. The app is free.

What not to do

• Use the app to harm, harass or deceive anyone, or in any way that breaks the law.
• Send the guide other people's private information.
• Test or probe the guide in ways that could take the service away from others, or try to get around the message limits.
• Copy, reverse engineer or extract the app's code or 3Joannes' material, except where the law allows it.
• Access the service with scripts or other automated means.

We may limit how many messages a device can send in a day so the service stays available to everyone.

What you send to the guide

What you write stays yours. You allow 3Joannes and the companies that do work for us to process it for one purpose only: producing the reply. We do not store it and do not use it for anything else. The privacy policy says exactly where it goes.

If you send feedback or suggestions, we may use them without owing you anything.

Content and ownership

The app, its design and 3Joannes' material belong to 3Joannes or its licensors and are protected by copyright, trademark and other laws. #WithYouToo, Sexual Assault First Aid and the Red Balloon are marks of 3Joannes. You can share what the guide says with the person you are helping; please don't republish the material as your own or use the marks without permission.

Phone numbers and links are checked when we publish them. If one is wrong, tell us and we'll fix it quickly.

Apple and Google

If you downloaded the app from the App Store, these terms are between you and 3Joannes, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for it, for any claim relating to it, or for any warranty; to the extent a warranty is not disclaimed, you may tell Apple and it may refund the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a United States embargo or designated as supporting terrorism, and that you are not on any United States list of prohibited parties.

If you downloaded the app from Google Play, you also agree to Google Play's terms of service.

Changes and ending

We may change, pause or discontinue the app or any part of it at any time, including the guide, which can be switched off when it needs attention. We may change these terms; the date at the top changes with them, and a material change is shown in the app. Using the app after a change means you accept it.

You can stop using the app at any time and remove everything it holds with "Clear everything on this device" under You, or by deleting the app. We may suspend access for anyone who breaks these terms. The sections on ownership, disclaimers, liability and governing law survive the end of these terms.

No warranty

The app and everything in it are provided as is and as available, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. We do not promise that the app will be uninterrupted, error-free or secure, or that the guide's answers will be accurate or complete.

Liability

To the extent the law allows, 3Joannes and the people and companies that work with it are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from the app or from decisions made with it. Our total liability for any claim relating to the app will not exceed one hundred US dollars (US$100). Nothing in these terms limits rights the law gives you that cannot be waived.

If your misuse of the app or breach of these terms leads to a claim against 3Joannes, you agree to cover the resulting costs, including reasonable legal fees.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Disputes that cannot be settled between us go to the state or federal courts in Delaware, and both of us accept their jurisdiction. If you live in a country whose consumer law gives you more protection, you keep it.

General

These terms and the privacy policy are the whole agreement between you and 3Joannes about the app. If a part of them cannot be enforced, the rest still applies. You may not transfer these terms to someone else; we may transfer them to a successor of 3Joannes. If we do not enforce a term once, we can still enforce it later. Export laws of the United States and of the place you are in apply to the app.
